WOA resumed billing me without notifying me, and then charged me $19.50 because the credit card number was no longer valid. My bank changed my credit card number while my account was on freeze. Second, I should be refunded a fee of $19.50 (I think) that was charged to my credit card sometime in December. My account was on freeze for much of that time (and should have been on freeze longer than it was, but they resumed billing without notifying me). The refund should appear back in the account within 4-7 business days.įirst, I should be refunded the $39 charged to my credit card on or about Februbecause I had not had the benefit of the first 12 months of membership. Due to billing before the one year was up (because of time added to the account due to closure) a refund has been issued in the amount of $39 due to payment billing before the one year was up. The annual fee was billed on the date of the on the agreement was signed and agreed to. The annual fee was charged on 2/18/20 and billed on 2/18/21 due to the original one year term being up in January 2021. Mr **** signed up for a one year commitment in January and the time for gym closure was added to the end of his commitment to allow for the 12 payments that were agreed to. During the time closed we suspended billing for all of our members until reopening.
According to our records this email was delivered to the email on file for Mr. On June 11th 2020 a mass communication email was sent to all members to alert that billing would resume on June 19th giving all members 8 days to alert us if they would like to continue the freeze on the account.
If the they refuse to cancel I will have no other choice but to file an ADA ********** I am filing this with the hopes that they will cancel as I did NOT sign a second contract. I was told there would be no hassle when the time came to cancel and well. The website they sent me to is not affiliated with said WORKOUT ANYTIME and seems to be some sort of catch all cancel service that wants to charge me $50.00 to cancel.NO THAT IS ABSOLUTELY NOT ACCEPTABLE! THEY WERE NOT AUTHORIZED TO RENEW!I am not able to drive due to disability and the fact that they refuse to cancel over the phone amounts to disability discrimination. They then put me on hold and when the girl came back she directed to or. I asked them what happens when I need to cancel and they said "either come in or call us." After January of this year we could no longer go to the gym due to my roommates work schedule and the fact that I am disabled and too blind to obtain a driver's license.Today I called and asked to cancel my membership and they told to come in to the gym and I replied that I am disabled and too blind to drive. My roommate *********************** was witness to this.They auto renewed anyway. I was VERY ADAMANT THAT I DID NOT WANT THE **** RENEWAL.
